EFFECTIVE DATE: June 29, 2015

This privacy policy (the “Privacy Policy”) applies to the information collected from you while you are using the Ritter Pharmaceuticals, Inc. (“Ritter”) website located at (the “Site”). In this document, “we”, “our” and “us” refer to Ritter, and “user,” “you” and “your” mean users of the Site.

This Privacy Policy was developed to help you understand what information we collect as well as how we use and safeguard the information you provide to us on our Site. You must be the age of majority in your jurisdiction (18 years old in most jurisdictions) in order to use our Site. If you are under the age of majority in your jurisdiction, then you may only use the Site with your parent or legal guardian’s permission.

Please read this Privacy Policy carefully. The Privacy Policy is incorporated into and made a part of our Terms of Use [URL]. As part of the Terms of Use, the Privacy Policy constitutes a binding agreement between you and us. BY USING OUR SITE, YOU AGREE THAT YOU (OR YOUR PARENT OR LEGAL GUARDIAN) HAVE READ, UNDERSTAND, AND ARE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN. IF YOU (OR YOUR PARENT OR LEGAL GUARDIAN) DO NOT AGREE WITH ANY PART OF THIS PRIVACY POLICY OR OUR TERMS OF USE, PLEASE DO NOT USE OR ACCESS THE SITE.

When you use our Site, we may collect personal information about you, such as your name and email address. For example, we collect your email address if you decide to sign up for the email “updates” function on our Site or if you email us. We use this information to respond to your inquiries or requests. We may also use this information to keep you informed about our latest developments or products.

At this time, Ritter does not use cookies and other web technologies. Cookies are small strings of text sent by a website to your browser which are then stored by your browser on your computer’s hard drive.

Our general policy is to not share the information described above with third parties without your prior consent. We may, however, share the information in some limited circumstances including:

• To enforce our Terms of Use;
• With law enforcement agencies, governmental officials or agencies or other third parties in response to a subpoena, court order or legal procedure;
• If we believe in good faith that the sharing is necessary to prevent imminent physical harm or financial loss to us; prevent report suspected illegal activity; protect anyone’s rights, property, or safety;
• With other business entities, should we plan to merge with or be acquired by that business entity or in connection with a partial or total sale of assets, bankruptcy, or another corporate change; and
• When you otherwise consent.

We use reasonable industry-accepted technology and controls to protect your data from disclosure to unauthorized third parties. Although these measures are typically effective, use of the internet and related computer systems is inherently vulnerable to unauthorized access or “hacking.” No guarantee can be given that all information you provide to us will not be accessed by unauthorized persons. Thus, please note that no method of transmission over the internet or method of electronic storage is 100% secure.

Our Site is not directed to children under 13 and we do not knowingly collect personal information from children under 13. If you are under 13, please stop using our Site. It is our policy not to knowingly solicit or permit children under 13 to provide their personal information for any purpose.

California law permits California residents to request and obtain from us once a year, free of charge, information about the personally identifiable information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information (e.g., name, cell phone number, email address, and certain demographic data) that was shared and the names and addresses of all third parties with which we shared information in the preceding calendar year. At this time, Ritter does not share personal information with third parties for their own direct marketing purposes so this requirement does not apply to us.
In addition, under California law, website operators are required to disclose how they respond to web browser “do not track” signals or other similar mechanisms that provide consumers with the ability to exercise choice regarding the collection of personally identifiable information of a consumer over time and across third party websites and apps, to the extent the operator engages in that collection. At this time, we do not track our customers’ personally identifiable information over time and across third-party websites and apps. This law also requires website and app operators to disclose whether third parties may collect personally identifiable information about their users’ online activities over time and across different websites and apps when the users use the operator’s website or app. We do not knowingly permit third parties to collect personally identifiable information about an individual consumer’s online activities over time and across different web sites and apps when a consumer uses our Site.
